this is a checking acct of mine he over draws all the time he puts money in it also but wants to write checks for cash and we half to pay over drafts

YES ITS ILLEGAL. I've asked my hub before if he would do it for me and he said people go to jail all the time for that, so NO WAY... he would know. He has a govt job.

Yes it is illegal to forge anyone else's signature. On checks, on contracts, on anything. Besides having to deal with the police consider this; Many companies will take you to court to get the money not caring if your signature was forged.

If both of your names are on the account and on the checks, then either one of you can write checks. If only your name is on there (even if you're married), only you can legal write the checks from that account.

If his name is NOT on the account then YES, IT'S ILLEGAL. However, you will have to sign an affidavit and press charges against him before the bank will reimburse any of the money and/or charges back. It doesn't matter how much money he puts in the account, all that matters is whether or not his name is on the account.

well if his name is not on the account regardless if your married or not he is not allowed to sign your name its illegal its called forgery its your check book tell him that the bank caught on that its not your signature on the checks and that there going to press charges it will work (whats a little white lie going to hurt)

Yes it is illegal...but the bank will not compare signatures for every single check transactions...so you have to tell them otherwise they won't do anything about it.

Take the checks away from him.

Technically it is forgery, But if you and your husband have an agreement then that's between the two of you.
