It depends on the state.

Some recognize sex-changes for purposes of gender-based laws. Some do not.

So, for example, in a state that doesn't recognize sex-change as having any legal effect, someone who was born male but is now female cannot marry a male, even though it is a male-female marriage they are attempting.

But someone who was born female and became male, can marry a male (making it a same-sex relationship in reality) because the birth certificate said one of them was female.

It's completely irrational, just like any other form of gender-bias when it comes to personal relationships.

Ya know, this spouse had to be a real pill to live with. I don't think this man should have to continue to pay spousal support. He is no longer paying it to the person who he said "I do" to. He/she made a conscientious choice to change their identity....she obviously wanted committed to the marriage because she wanted to be a male. I feel for this guy (the man that has to pay support). Just wrong.......

Gender plays no part in awarding of alimony - nor do you have to married to be required to pay it

Obviously not. It wouldn't be the same person he was married to.
