What do i have to do to obtain a restraining order against somone. Can i just file for one or do they have to be arrested for stalking first?

go to your local courthouse to file your a restraining order....a temporary one will be issued immediately and a court date will be set
If this person has threatened you or harmed you physically ....go to the police and file a complaint

I'm not sure about New York, but in Kentucky you just have to go the courthouse and file for one.

Go to the police station. You may have to have some kind of proof to back up your story but if your life is endanger they will most likely do everything they can to keep you out of harms way.
