my husband was a over the road truck driver and died from a heart attach in another state. He didn't Pass in the truck but called 911 for help to be checked out.I believe from his phone records he was trying to get out from under the load but they told him to keep going with it. They have been known to do that in the past.

The cause of death would have to be employment related for you to collect Comp (such as if it had been a wreck). I don't think a heart attack is going to qualify.

Depends on whether tha accident was job related or not, you may have a claim. Not sure a heart attack would qualify, however, the fact that they told him to continue may have weight in your case. Usually workers comp covers people who are INJURED on the job. Verify with your attorney and gather as much info as possible. Phone logs, time cards, anything that would prove he was clocked in.

Either way, you will get your life insurance policy if you had one.

Nope but you can sue the trucking company and after the lawyers finish you will get 5 to 10 thousand dollars. Check into social security now as he paid it and as his widow, you deserve it a lot more than some of those illegals.

I don't know about workers comp issues on this. You need to contact a lawyer to see about this. It seems like it could be very complicated. If you have a case and you do not have a lot of money, a lawyer might take it on a contingency basis.

get a lawyer and keep all your phone logs and his...as well as any evidence that proves he was where he was because of his job...and a record or documentation of the companys practices in the past will be helpful in proving that the company made them do things not on the up and up....

Strong possibility, check with the company he was working for. Check insurance policies, if all else fails talk with a attorney.
