if you have a tenant thats claiming dss and the council write to you, do you have to show them any mortgage certificates or anything?

just wanting to know as im on a joint mortgage and we have split. would the council want permission from us both or will they not need to know?

people arnt clear what i mean. basically, i have a house on a joint mortgage with my ex. weve decided to rent out the property and the tenant weve rented it to is claiming housing benefit.

what i want to know is when the council get in touch with me to confirm i will accept dss, do i need to show the council any proof im the landlord by sending off my mortgage certificate.

i had to sign a form that I would not be increasing the rent for a year..........
all I had to do..
the council had access to the city logs..and knew..i was the owner.
they just didn't want the family to have to worry about moving..again..

I'm really not clear what you are asking, but I can say this. If a tenant is claiming housing benefit, that is between him/her and the Council, it is nothing to do with the landlord. The only time the landlord becomes involved is if there are arrears and that landlord asks for the benefit to be paid direct. If, on the other hand, you are saying you are going into rented accommodation because of the split and may need to claim Housing Benefit, then yes, whilst you remain an owner of the other house and are liable to pay the mortgage repayments, the Council may need to see evidence of those payments and your responsibility to pay them.

You should not need to show any proof. If they want to know the true owner they should check with your town clerk/tax collector.
