The coUrt asks the police to summon your spouse from jail. They don't much ask for reasons as the very fact that ur spouse is in jail can be given as the reason for divorce.

Laws are the same. Its all in how you file for the divorce, like you can file a single signature divorce. Ask the court clerk, theyre usually pretty helpful in this area. Youll have to explain to the Judge your story once you get into court but no big deal. Depending on what hes being held on will decide if he will be in divorce court. Good luck

Divorce laws vary state by state... so it doesn't matter if the spouse is incarcerated or not, start by checking with county based agencies regarding initiating a divorce and take it from there.
