In the Tiucsan medical facility in Arizona, i sought treatment for a broken metarsal bone,which had been broken at least ten years, i was examined and asked for them to correct the break, what they told me was,"it had already healed, they did not want to operate,and wanted me to wear supportive inserts and other to support the foot, this i was not satisfied with,,,,,in time i went to nyc, and consulted the va hosp in Kingsbridge on Kingsbridge rd in the Bronx where i was told the same things by the head of Poditry depts, i was not satisfied, with their recommendations,,,, i sought help elsewhere a private podiatrist,, who recommended another podatrist as a result, surgery was preformed,successfully, and my foot is on the mend i am satisfied and greatful,

question now, can i sue the va adminstration or doctors who would not utilize surgical methods to bring desired results.
the va hosps have been great to me on prior occassions

just want to know,what is possible in such a situation, they provided treatment, but what i was not satisfied with, can the va be sued for not providing treatment i wanted that proved more than satisfactory.>?

The answer is no. That is why there are second opinions and in your case thirds. I work at a VA hospital. The back log of surgeries is ridiculous. If they operated on everyone who wanted surgery the docs would be operating 24 hours a day 7 days a week. I can understand your frustration, but you really don't have a case. Its the old "you say potato, I say patato routine.

I dont think so. That was an elective surgery. If your foot wasnt posing a major risk to your life, was just a nagging inconvenience, then they didnt do anything wrong. If a person on Medicaid had the same problem I sincerely doubt that any podiatrist would do the surgery. (I'm not implying that you're on Medicaid but your care is provided by the government). Sorry, while it sucks, I dont think you have a case.

you cannot sue the govt. the VA gave you a medically acceptable diagnosis and treatment plan and just because you didn't like the plan that did not make it wrong or the facility negligent. ten years is a long time to wait to correct any kind of a break.

I dont think you can sue.They could only help you the best they knew and they did,nt know alot so could,nt help you but it is good you did,nt give up on resolving the problum and now your getting better.Get Well Soon
