On Law and Order a transgendered woman is sent to a mans prison why?

Why I wonder do they see her as still a man and
clearly she is a woman and she is a she
and yet she
is convicted of murder and sent to a mans prison and
she is brutally gang raped and it is so horrible and
very sad I cried and cried
And she was taken to a hospital
and the public defenders from Law and Order go and
see her in the hospital
It was so horrible and it makes me sick that our courts and
the law see her as a he and she is a woman without any
doubt in my mind and I am so angry' and mad'
at our Justice System it is so screwed up thinking that
male to females are still male arrrrg I am angry
and somebody needs to fix the dam system

I do not want to see a transgendered woman or a
transgendered man end up in a womans prison and
vice versa she ends up in a mans prison is very wrong
Our law makers should look into this and this
Law and Order I saw was Fallacy 2003 and so shocking
to see this and I am a woman myself

So yes this is only a television
show with actors and
actresses but in real life I wonder
what would happen to a female> male
if he would be sent to a womens or mans prison if convicted of murder and
if they would consider him still a female
and yet he looks so much manly
and male
in every shape and form the breasts
have been removed and he she has
a penis I wonder what prison they
would send him her to and this must
be confusing to the judges and
courts what prison to send them to
The male to females
should be sent to a womans prison
no matter what and under all
circumstances and they really are
women and should not be
in a mens prison at all this just
baffles me

As a mother of a troubled transgendered teen, we went through this before 18. they kept her in isolation. . as for the system, I agree, something needs to be done. You have to go through so much red tape to get anything done. With my child, he/she was considered neither, and kept out of site. At boot camp, he did not have to do all the things everyone else did. I think there should be a middle ground, more protection. But , they broke the law, and do deserve to be punished.

To 'X' I'd just like to say, you clearly know very little about chromosomes, chromosomal variations, and really anything to do with being TS or IS.
Chromosomes aren't as important as you think.

To the point though, yes it's only fiction, but based on the legal system of the USA, where a correction of the birth certificate would be necessary before ones true gender could be recognised, it's actually part of the legal recognition process. The criteria for recognition often requires genitoplasty to be performed prior to recognition, though not in all countries.

I saw that episode and it really upset me also. But technically speaking if she still had a penis she is still a man and that's why she was sent to a male prison. Our law system is extremely screwed up and many people get away with murder b/c of technicalities.

2. She has not changed her birth certificate, or
3. That is where she wanted to go.
When I say whole program, I mean the psychological prep, the hormonal treatments and the surgical procedures necessary.

It's fake. It's a t.v. show. And he is a man. Putting on a dress, getting breast implants and a man-made vagina, doesn't change him from a man to a woman. Cut him up anyway he likes, he will still have a X and one Y chromosome (which makes him male).

because she never got the surgery to change what's down there in her private area. in america, what's down there is what you are considered to be. but that was harsh. and they should have known when they put her in there, she would have gotten gang raped.
