We just moved into the new house built by the builder. The builder made many excuses not to start to build the patio before the closing date. Can I sue him and what shall I do?

Kind of late now but in the future have a lawyer present at the closing. Funds can be with held until the work is completed. This means the builder gets no pay until you sign off that the work is complete to your satisfaction. Not knowing the section of the country you live in there may have been good reasons, like weather in the north, rain in the south, etc. You also have not mention what type of patio, on the ground or built off the ground like a low deck.
