I read this article as well and it said that the law read that only if she remarries or dies, the alimony would stop. That's where I think this man should fight having to pay alimony. She, in a sense, is dead. She is now a man, she changed her name, and the woman she used to be no longer exists, according to her own will and doing. I think this man's lawyers should use this avenue to fight the alimony. If their state doesn't recognize same sex marriages, it is impossible for these two to ever reconcile. If she feels she was a man all along in a woman's body, she should have to pay back the alimony. Damn, I should have been a lawyer!
If they are going to uphold this in court, then they should ban sex changes!

Spousal support is an obligation established by law and she (who is now a he) was your wife and I presume it was ruled by the court for you to pay alimony.
The sex change operation of your ex-wife is not a valid excuse for you to stop paying alimony because her action/decision to change her private parts does not violate an alimony agreement.
We have to go back to the very reason why you have to pay alimony, first spousal support was requested of you and that is your duty since you married her and you are not the poorer of the two parties, and this was granted during the course of the litigation....
so until you have paid for the alimony i.e. for a certain number of years as prescribed by the court...that will be the only time that you will be given the right to stop paying for spousal support...

Hey that is no lady! I mean she/he probably changed her/his name to match his new gender. Since same sex marriages are not accepted or legal, seems like same sex divorces shouldn't be legal either! I would fight it tooth and nail all the way to the Supreme Court. I am a regular woman and alimony is not allowed in my state. I was married for 22 years and got nothing but ******over. But, the best revenge is to be happy and I am. I just could be so much happier if I was able to get alimony!

It shouldn't depend on gender. It should depend on whether that person REQUIRES the alimony or not. If they are able to work and provide a similar living / income to what was established during the marriage then I say discontinue the alimony. But, if the PERSON (male/female) is going to be left in a difficult financial situation (opposite of what was given during marriage) then I say YES continue to pay alimony.

for my area confident...and it hurts to pay countless alimony to my ex spouse! Alimony is approximately giving the different individual a level of the existence-style they have been used to in the process the marriage. no rely if or no longer they're a guy or a woman, if there exchange right into a distinction in earning potentials or sacrifices made for the marriage, then alimony applices. i could say that if she enters right into a kinfolk partnership with somebody, then it fairly is time to diminish off alimony.

Yes, you are paying alimony because you were married to her and the judge ordered it. Just because she has a penis now, doesn't mean that it's not the same person, She (he?) should still get the money. Unless you think because of the sex change operation he'll be able to make more money. hehehe Life is so unfair.

yes, because there are also no laws that say that if you get a sex change that you some how cease to have any of your previous commitments. on top of that you dont just wake up one day and decide you are a man trapped in a woman's body there are signs usually for years. he married her and probably divorced her due directly or indirectly to those issues she was having at the time. he is responsible just like anyone else. just because she changed sexes and people find that uncomfortable doesnt change the fundamentals of a case like that.

Yes. If a man is married to a woman and he has a sex change to become a woman he is still legally married. Just because she got diff equipment doesnt change anything that happened during the marriage or divorce.

The she that is now a he, was once your wife.
Teehee!
Seek the advice of an attorney.
I don't understand WHY people ask questions like this on
here.
If Legal Advice was that easy to get, we wouldn't be paying
the fees we pay for attorneys'.
However they over charge people to pay for the luxuries they
have.
Which brings me back to saying this: Consult an atty., and
go from there.
Good Luck!

Now this is a good question. Tricky.
Well, these people that make these sex changes, want to be treated by what move they make, from male to female (they want to be treated as a female) and female to male (want to be treated as a male) from what I've come to known, so No, he should NOT have to continue his payments.
The article states clearly why.
