Okay i am 25 yrs old and married 4.5 yrs leagally have a 5 yr old son from a prior relationship.My hubby and i dated 2.5 yrs in college but took a break for a year.That was the time when i met up started seeing my first(ex.bf) bf on and off again.The aftermath was the relationship flopped with my ex.bf i graduated college pregnant with my son by him who was born early morning the day after graduation.My hubby and i were friends through the pregnancy and a few months after i gave birth starting seeing each other again got married soon after.Things were kind off rocky i felt that he resented me having a child.My ex.bf paid child support underhand because he was engaged did not want gf to know and visited my son every once in a while which made my hubby even more upset. My hubby cheated on me with someone at work i found out by accident when i answered his cell.I moved out and have not seen hubby in 2.5 yrs. Leagally can he get money from me?

I am currently living with my son bio-dad and have a 1.5 daughter now and have moved on.Does my leagal hubby who has just served me divorce papers have the right to half my money?

I think you should get the divorce papers if you don't plan on reuniting with your husband. Not being legally separated will hinder any future marriage plans should you find another man you want to marry. Did you draft a prenuptial? If you did, then whatever terms are in that document will decide how your assets will be divided. Otherwise, it depends on whether he'd want to claim spousal support. I'd definitely consult a lawyer, and get that divorce. Good luck with everything.

Does he have the right to half your money for what??? Your husband isn't raising your child, is he? Does he have custody of your child? If not, then you don't owe him any child support. If he's working, then you don't owe him any alimony. If HE filed for divorce, then technically he's the one divorcing you, so he's the one ending the marriage and not only do you not owe him anything, but he may have to pay your legal fees. Also, can you prove adultery on his part? The only thing you may be liable for is if you own any property together, in which case you may have to sell it and split the proceeds.

this is why it is all ways wise to file a legal separation but since you did not if your name is on the lease of your new boyfriends place or you can prove that you guys have been apart for a certain amount of time then he may not be entitled to it but its proving that you guys were apart so start there from that point you then need to go get a lawyer!

He may be entitled to 1/2 of what ever you gained while you were married, but even that is questionable, since he abandoned you. Get an attorney.

sounds like he may be, you did not say what state your in, so a lot depends on that, but if there is no pre nup then yes he is entitled to half of everything and depending on how much he makes verse how much you make, you could end up paying him alimony, you need to get an attorney right away!! welcome to what men have had to endure for our hole lives.

the law varies state to state. the best way to find out what to did is talk to a lawyer (normally they know what they are talking about). sense he cheated on you that makes in the reason for the divorce

i don't think so because u don't have to pay child support to him because the kids aren't his and i have never heard of the wife having to pay alimony to the husband. i would check with a lawyer tho.

Yes he is entitled to something, not sure half but he is entitled to something. Your best bet is to talk to a Lawyer! Good Luck!
