Rather than file a lawsuit, file a complaint with EEOC and they will open an investigation. Understand, however, that it is always possible that a more qualified candidate applied for the job, regardless of race. There is no law against choosing the most qualified candidate as long as the employer does not discriminate on the basis of race, sex, or religion.

First off, how do you know it was beacuse of your race? could it have been that their was another qualified canidate? Did the bosses nephew need a job? Did you not impress in the interview? Did you ask the company why you were not hired?
Race does not have to be the first thing that people always jump to when something does not happen they way you want.

How does one know they were rejected due to their race? The first lawsuit would be racial discrimination. Then one could argue personal emotional injury due to the discrimination, but probably only if they had a good racial discrimination case.

Federal discrimination. But, what makes you think it was based on race. My business has been sued 20 times and I won everyone. If you are not the most qualified, then you are not.

file an eeoc complaint. discrimination based on race is a federal offence and is always investigated by the eeoc. if found guilty, a civil action can be filed as a violation of equal opprotunity in employment.

It's difficult to prove. Did they actually tell you that, or say something racist to make you believe that? If so, find an attorney that specializes in that. they can tell you if you have a good case.
edit: I hope your friend kept the email! sounds like they have a very strong case, as long as they hold onto it!
