Help me please... i filed a divorce and i'm currently in Florida. My ex-husband to be is in the Philippines and we have not talked for over half a year. I just spoke with the paralegal and she's asking for an address where the documents could be served (by a sherrif). She informed me that the address should be where my ex resides, but i just dont know. Can I use my sister's address instead? Any body know about this situation? HELP PLEASE.....

He's a kind'a violent. I'm quite sure he'll bother my relatives back there... violently. that's my problem.. =(

Most states have publication provisions that will allow you to publish your divorce notice in the paper for a set amount of time. These provisions are in place for those instances when one person is abandoned by the other and simply cannot be found.

Well I'm not going through a divorce I'm just going for child support but they needed his current address where he is. They wouldn't even accept his parents. I'm not sure how you can get it without talking to him. I don't think they can search by his social security number if he had a job since it's just a divorce. Good luck getting it.

No, you can't use your sister's address instead unless your husband is living with your sister. The papers have to be served to him in person and must be signed for.

When they told you that "he" needed to be served with papers were you asleep at the time?

You can't use any place other than where he is living since he actually needs to physically be served with the papers. Since he is out of the country, you need to go another route. You need to go to a real lawyer, someone who actually knows what the heck they are doing.

He must be personally served. Get his address and give it to the paralegal. There is NO other way to serve him.

Do what you were told to do. You have to have the papers served to HIM not a stand in.

Find out where he is and get it done. If he has a job, you could also have him served at work.......

You're a woman you can do this heck we can do any thing!

He has to get them in person, thats why a sheriff always delivers divorce paper. I suggest you find out his location, maybe his family knows, so you can get a proper address.

Have you discussed your situation with your lawyer? If the answer is no, you should, because you do not want to lie with legal documentations. Perhaps there is another way to resolve this issue.

i would file abandonment. they will place ads in the paper for him in the last location you knew and if he does not respond in so many days (i think its like 6 mos or so) your divorce wish will be granted.
my ex refused to divorce me. he wouldnt tell me where he lived to serve him so i did the best i could and now im happily divorced!
