I sent him papers but he never returned them ,now no one knows his whereabouts.The sherriff tried to serve him but couldn't find him. we seperated April 7,2006. I have papers typed up.I am not using a lawyer,I can't afford one.

You will have to check the actual law but I believe you can advertise in a newpaper for a set amount of time (as a good faith effort to locate your husband) and then file w/o him.

Go to your local County seat(courthouse) to the "family" division and ask them if you were to run an ad in the paper for say 30 or 60 days in the legal section of his last known address and he does not respond then can you file for a divorce and it legally be granted by the courts as he would have had ample time to respond. They should be able to help you with this matter

the person who said the ad in the paper is correct it has to be done in the town he was last in and for a certain amount of time but i have a friend who did this and she is now divorced so it works! and from what i know it can be any news paper does not have to be a big one and it may have to be 2 different ones my Friend had to do a local paper and then another of her choice in his last known town and it was simple and many papers deal with this a lot!

Advertise in a local newspaper under announcements. I think it needs to run for 30 days. Also contact anyone you can that might know where he is. That way you can show the court that you've made resonable efforts to contact your wayward spouse.

No problem..go to your local county office (it maybe the police or fire station..I do not know where you live....Anyway..it is free to file...you can claim "abandonment"...they will direct you in the right direction.
