My sister just found out that her husband has been cleaning out her bank account writing checks. He isn't on her account, so he shouldn't be able to write checks, but the bank has been letting them go through. She just got paid and he took her whole paycheck. She has a three year old and a one year old child. She goes to work, comes home and takes care of the kids. She also buys everything.

If he's not on the account and is not listed as an authorized signer with the bank, they are not supposed to let him write them. Furthermore, the stores who accepted the checks should not have allowed him to write them since it wasn't his name on the check, but good luck with that.

I think the only way she could have a leg to stand on with suing the bank is if she has her husband arrested and presses charges against him for theft. I doubt she'll want to take it that far, but if she doesn't, the bank will likely just shrug and say, oh well.

She should be able to go to the bank and get them to refund the money -- but that'll result in bank fraud charges being filed against the hubby.

No, she should sue her husband and herself. Her husband for writing the checks and her for allowing him to do so, has she ever heard of keeping her valuables safe?
