Is it considered a run away in Legal terms?........................... --------------What can happen to a buddy (best friend) who knows about his intentions and doesnt say nething to his parents before it happens (the bestfriend is 19)? -----------

For the period of time he is gone he is considered a runaway. When he comes back, he's back. If he travels with someone over the age of 18 they could get prosecuted for transporting a minor across state lines. The older person who knows about his intentions would be best advised to notify the parents of the boy's plans. If he was contacted during the boy's absence and lied about knowing his whereabouts he could be prosecuted for obstruction.

Then he would be considered a runaway, and anyone who knows about his intentions and whereabouts and doesn't inform his parents would be legally responsible. They could be arrested for contributing to the delinquency of a minor, or if they went on any part of the trip there could even be federal kidnapping charges (crossing state lines). Not to mention when the teen comes back there would be the police to answer to for the report his parents filed.

For all the trouble and worry it would cause, the teen would be better served to wait the less than 365 days until his birthday, take his best friend, and then celebrate his coming-of-age party in another state.

yes. if his parents call it in, he is a runaway.
the 19 year old cant get in trouble for just knowing and not saying anything. but if he goes with the 17 year old he could get convicted for taking a minor across state lines. (some states consider it a felony and others dont, but its still punishable) The 19 year old could go to jail for about 5 years. (they consider it kidnapping in some states and thats the sentence for kidnapping)
if his parents call him in missing (which i bet they will if he doesnt get their permission) then he will be considered a runaway, and as soon as he is caught he will most likely be put in Juvie until he can have a court date and figure out if he should be allowed to stay in his house and if his parents are fit to take care of him. If the court decides not to let him go home, he must stay in Juvie until his next hearing which most of the time is atleast a few months.
I would strongly suggest just ASKING THE PARENTS. That can save a lot of trouble, not to mention probably save him from going to Juvie.

As his best friend I suggest you say something. It's a matter of tough love- something you'll learn when you have kids some day. You don't do it because you're a horrible mean person and you're ratting them out; you do it because you care about them and are worried for their safety. If he does do this, his parents can have him arrested and sent to juvenille hall as a minor and as a run away. MTV has a show about this; maybe he should watch it and decide if it's more fun to NOT go or to go and then spend a nice few days at juvenille hall....

Again, I would say something to someone. Do it because you care. Can you get in trouble? Legally no. But think about his parents and the pain that they will have to go through. You can be a kid or a responsible adult in this situation. Time to grow up and be an adult.

if an adult 18 or over transports a minor across state lines it is a felony. If the child transports himself nothing you can do. Let your child realize the grass is NEVER greener on the other side of the fence. State to state has varying runaway laws. Check your state, many states will lock the child up for running away. which is probably what your child needs for a reality check.

im sure they could report him missing, while he is gona, but once he comes back , he is not a runaway because his intentions were to come back, and they cant do anything to the friend just for knowing.. unless the 19 year old took the 17 year old out of state...

ur kid has his own mind, dont blame others, if the other guy didnt wanna say anything he didnt wanna get involved. Ur son has his own mind and no he's not running away, he's just being a rebel teen. He needs to be punished.
