The final decision is up to the court so it depends on the judge and how he views psychological testing.

Is this a custody battle or is the state involved?

I'm no expert, but I'm going to tell you what I have seen in my experience as a paralegal whose boss has done plenty of child custody work.

I have never seen the results of such testing alone lead to the removal of any kids from a parent. I have seen it allowed as evidence where there were other issues -such as abuse, neglect, or criminal activity by the parent who was made to take the test.

Also, this is probably best answered by a lawyer in your state, because laws governing custody and other family issues vary greatly from state to state. I could tell you "no way", and it might be true in my state and totally false in yours. Ask a pro.

Psychological testing is often used in determining parental fitness. However, such testing should only be used as one part of such an evaluation. There is no single psychological test that can be used to say you are an unfit parent.
