Every morning I'm awoken by birds scratching and pecking and whatever they do on the guttering outside my bedroom window..
I rang the council but was informed that i can't remove the nest as black birds / starlings are protected and could be fined like 5000.(these are black birds)

how can i get rid of them without killing anything?

I know this sounds stupid, but it worked for my grandparents, Lay those little play rubber snakes on the roof, and on your window sill. if you can get ot hte gutters without falling it would be good to put one in that like its comingout of the gutter. also, hang an aluminum pie plate outside your window on a string. I don't know why these things work, but, they are both proven.

Valentina B has given the answer that worked for us.

We had a problem with starlings nesting in our guttering. In fact nearly every house in our close had early morning and late night disturbances from the blighters! Garden mesh (thicker than chicken wire) rolled and put in the gutters deters them. Make sure it is packed in so they cannot pull it out - because they will try. We assisted our neighbour with the problem and neither of us ever had to endure the noise/trouble again. I don't think it will be blackbirds nesting though - they build nests in bushes/thickets usually to be near the ground.

Try putting some wire mesh over the gutter so they can't get into it. Water should still be able to go into the gutter. If they can't make a successful nest, then they may go elsewhere.

No whatever you do , do not move the nest as its suppose to be bad luck. I too had this problem, there is a little sensor you can get that will hunt all vermin, and birds away. Us human cannot here the buzzing it makes but it drives everything else goes mad.And they soon will move away of there own free will.

We had the same problem with downtown Louisville. the maintenance guys wanted to poison them because they were so bad it was becoming a health hazard.
The bleeding hearts cried that it was inhuman to kill them. They wound up installing some type of expensive audio system that generated a high pitch noise that the birds didn't like. that may have helped downtown but they just migrated further out and now the suburbs have the problems.

I know what you mean, I have the same trouble! Not only do they disturb my sleep but my window gets covered in bird poo!
I find that shouting out of the window, something along the lines of "f*ck of or I`ll put you in a fu**ing pie you c**ts" or whatever else springs to mind when you have just been woken from a peaceful, comfortable, well earned slumber makes them scatter long enough for me to get back to sleep!

Birds like all creatures do not like smoke, just find some thing that gives off a harmless smoke like a string and burn it under the nest a few times, they won't like it.

Get a cat! I haven't seen a bird within 5 yards of my house since moving in with my cat.

try putting some moth balls in the gutter. or, just keep the gutter cleaned out. the birds are picking up insects and seeds that lay in your gutter.

I personally like the birds they keep the gutters clean.If you keep your gutters clean there will be no insects for them.So theres your answer.
