my daughter started school last September, when she did i asked if she could use my name instead of her fathers as her sister has my name and will be going to that same school, so that my daughter wouldnt get confused when people asked her i changed it. Now her father knows i have done that he says hes going to change it back, he does have parental rights as of 2 weeks ago, he left when my daughter was 16 months and i have done everything on my own without him and he now thinks he can order things about, can he have her named changed back it is stil her fathers name on school records but in class its my name, i dont want her getting more confused when she has to start using his name in class if he does change it.

You haven't had your daughter's name changed legally. . .basically it appears that you have just asked that the teachers use your name when they call roll or in class. If she is registered under his name, I don't think there is anything he can legally do about it, and I doubt the school is going to go along with what he asks since you are her primary guardian. I imagine he's just blowing smoke and won't go to the school.

Why not speak to your daughter and ask her if she is happy having the same name as her siblings. I must admit if her name is different at school, other kids may mock her,and it can cause people to gossip and be nasty.
If your daughter wants to keep the name, Why not speak to your ex,or get her to ask him. Maybe he will understand how much easier it will be for her to keep the name you changed it to.
If he has his daughters best interests at heart, he should agree,even though he does have rights.

Unless he has parental rights, he cannot do this. Take legal action against him, as it was your daughters choice to use your name and he doesn't have a right to make her change it back. H eleft you and you are the person looking after your daughter, hereby making you her legal parent, gaurdian, whatever they call it nowadays.

But if he is on the Birth Certificate, he does have some rights and is hereby legally aloud to do this, so as I instructed, take legal action.

I don't know if he as the legal right, you need to talk to your lawyer about that but if he is trying to be involved in her life I would think you would want your daughter to be close to him and since it is her dad why wouldn't she have his name? anyway how would this confuse her? Its her dad. It is not confusing at all.
It might be confusing to her that her sister has a different name.(I'm assuming a different dad)thats what is confusing to a child but that is not his fault. I can understand him wanting her to have his name. He may have left you all but obviously he wants to remain in her life. He deserves that chance.

if he paying mainetenance, and is there when ur daughter needs him, then he can probably chage her name back, what difference does it make that ur other daughter has different name, i think i know what this is about, but i won't go into it, if u email me, i will give u more information, i am a lawyer, i can help u with this for free

why does he have parental rights if you have her 24/7?If she was born 2002 or before you should have parental rights and be able to say what surname she has.If it is different from the birth certificate you could change it by deed poll?

i have been thru this it is not legal unless a judge says otherwise i am your ex has rights whether he deserves them or not sorry
