My ex husband and I got divorced in 2000. He never completed his visitation certificate that is mandatory in IL. He has not seen our 2 children in 5 years. He did seen them for the first few every now and then when he decided to but then just stopped when he obtained a new girlfriend. He lives in the next town but does not call has no contact what so ever do to his own personal choice. Yet he will send child support. I have asked that he sign over the children so that my new husband and wonderful father to my children can adopt them, but he has refused saying it would make me happy, It was not a pretty marriage or divorce. Is It true that after not seeing you children for 1yr is considered abandonment by the father and how would child support factor in on getting his parental rights revoked?

i've never heard that one before... because today, the courts wont let you just sign away your rights, unless there is someone willing to adopt the child (such as a new spouse).

and now he has a new gf, he has to pretend to be a great father... i know what ya mean, my ex did it too.. with every new gf he had (LOL)... til they too left 'em.

in any case, i would say NOPE.

you can contact your local legal aid office and ask them. maybe they know. or get an appt with an attorney (first consult is free kind of attorney).

NO that is not true. He is making payments. Leave it alone. The kids will know full well who their "father" is...the one that cares for them, is there everyday for them. The natural father is a fool, has lost his children through neglect, but at least, keep the money. IF you and your present were to adopt, the child support payments would end. I am surprised the ex doesn't say yes, go ahead...but stranger things have happened. OF course, there is a really good way to get him to change his mind about this...go back to court and get the child support payments upped...in this day and age, about 500.00 per month per child is average. Here in CA, 750 per month is average, and they take no excuses for non payment. IF he has to pay out money like this, he may well be glad to end his role in their lives. Good luck

not sure about the law in IL but in MI there is nothing you would be able to do. I would contact a lawyer to make sure though (why people come to these sites for answers on this stuff is beyond me)

I would think that if he doesn't want to relinquish then you are forced to keep things as they are.

If he is only doing it because it makes you mad then turn it around on him. When he says he won't do it because it would make you happy, just tell him he's wrong, what makes you happy is the fact that he is out of your life for good and you still get to take his money every month and it won't stop unless he signs off so you're sitting pretty as a peach on part of his paycheck. It's like getting paid to divorce his a$$, easy money.

It's a low way to go since most people are touchy about money but it might make him come around.

Contact your divorce atty. before he destroys your old file. tell him what's going on. They generally only keep the records for 7 yrs. and he'll have all the notes from the beginning.

I believe he is the only one who can revoke his parental rights.
He's very childish to be withholding his own children from getting to know him. He's all thinking he's high and mighty and thinks he's hurting you!!

IF he only shows up every now and then...........why even answer the door?

Is it possible you can move?? Have a post office box so the support can still be received?

bio dad will always have rights unless he decides to sign off on them...as long as he is not seeing them...this should not be a problem for u...afterall they are his children
