Has anyone out there used one of the "accident claim" companies who advertise on tv. Just interested as they claim that the inured person gets 100 per cent conpensation. Surely after you get your cheque, you have a bill to settle?

They claim their expences from whoever you are suing, if you win the other person pays, the solicitor has insurance incase you loose so they dont end up out of pocket.

It's a little bit of a con.

The accident claim company deal with the insurers of the person/company who caused the accident.

They agree 2 separate figures - compensation and costs. You get the compensation, and the accident claim people get the costs.

I wouldn't be at all surprised if the costs were higher, and the compensation lower, than you would get if you took legal action yourself.

But who am I to say?

Personally, I wouldn't touch them with a bargepole. If you've got a legitimate claim you can go through the small claims procedure. The Citizens Advice Bureau would be able to advise on this.

Some of them operate a scheme whereby they arrange a loan to you which covers their costs in settling the claim. At the end the compensation repays the loan and their costs and you get the remainder (if there is any). You got 100% of the compensation and they (the lawyers) got their costs. Did they tell a lie?
They did not say that the compensation would cover 100% of their costs though did they? If their is a shortfall who do you think has to pay? The lawyers or you?

They take a third of the awarded money.

They'll only accept cases they think they can win.

Sometimes it's a rip - because some of it is money you could get from your insurance anyway, but they file. For instance, my ex-wife was in an accident, insurance would have covered $60,000 anyway, regardless. They filed, got the $60k, then took $20k for themselves.

If you think it's REALLY open an shut, it might make more money to hire someone directly. Of course, you'd have to pay regardless of whether you won or lost, but the injury lawyers wouldn't take the case unless they thought they could win anyway,

In most insurance policies the insured person needs to make an upfront amount. The balance shall be paid by the insurance company. How the companies make monies differs. I like to believe the most would blow up the claim amount.

You DO get 100% of your claim. They or the solicitor you use will also send you a bill.. so yes you receive the full amount but you will also have a bill to pay afterwards!

As well as winning compensation for the victims they are also able to claim all their expenses - this is why they never take on a case unless they're sure they can win it for you!

I have never done it, but I think the 'other side' pay the solicitors fees, which is why the claimant gets 100% compo.

they claim their fee on top of your compensation from the person your sueing.

personally i would never use one through principal
