My sister-n-law is past due on her rent and has been evicted. She lives in a trailer park, but she owns the trailer and it is in her name. Even though she owes the back rent is it legal for her to go ahead and pull her trailer out?

That depends on when she signed the lease for the lot. If on the lease it specifically says that she has to be fully paid up before she can move it off the lot, then no, it's not legal. If no where on the lease it says nothing about moving the trailer, then she can move her trailer as she pleases. It costs several thousand dollars to move a single sided trailer so she's probably better off just paying what she owes. Good luck on this...

Sometimes the trailer park will try to stop you by parking a truck or something like that in front of the home so it can not be pulled. the police will not help in this case either. Tis has to go to court to be resolved if they do that.

also It is very costly to move a mobile home if she has the money to do that then she should be able to catch up on the rent.

In some cases you can also give the title to the park in Laue of the rent. then you would be free and clear of everything.

The agreement is between two legal entities and not with the trailer. Unless there are provisions on the lease agreement not allowing an asset to be removed from the premises relating to security to any debt incurred as a direct result of the violation of the terms of the lease or there is a court order not allowing it, I can't imagine why not. However there are state regulations in each state governing those issues and they are contained within the state's landlord tenant act so you do need to check those.

If she's been evicted for nonpayment of the lot rent, she MUST pull the trailer out.

Yes, it's legal. The trailer is hers, the land isn't. She can just move it to the nearest Wal Mart parking lot.
