Its the rules of the contract you sign. I have overtime and don't get paid for any of it.

i use the old "humanist" rate of overtime for my rate of pay i:e i work to suit myself. if ordered to do overtime i dont do it and say no! i wouldnt care if i was a fireperson or a doctor if i aint gettin the extras then you aint getting the work from me. my dad worked saturdays and sundays at the same hourly rate because of that i boogie into work upbeat and work 9-5 but no longer or earlier. and i dont do weekends. 37 1/2 hours is the legal minimum per week. nobody can force you to do overtime! as for breaking the law the answer is no! i suspect your dad is on price work, by quantity/output not hours worked.

IT depends on the state, and if your dad is considered an exempt employee or not.
