can a person over 21 get child support from there father. if he was supposed to be paying while thay where a kid but he never payed? is there anything one can do about that? a friend of mine wanted me to ask and find out. cause i honestly dont know

If there was a court order in place ordering the father to pay child support while your friend was still a minor and he didn't pay, then, yes, the back child support (arrearage) is still owed and can be collected. However, I am not sure to whom the back support will go (i.e., whether it will go to your friend or the mother).

The primary parent, who raised the child while still a minor must be the one to prove child support wasn't paid and take the non paying parent to court. If any monies are won, it goes to the primary parent, not the child.

I think you can get back child support, but the mother has to apply and provide proof of the dna between the father and child and proof that he wasn't paying her.
the mother should apply.
don't look at this as a way for the daughter to get money now

It's the MOM who is supposed to get it, not the child. I don't think you can get it without a big court fight. There may be a statute of limitations. At least that's probably what my ex is hoping.

My ex had that problem. He found out that the other parent has to go for it. The child can't- at least not in Wisconsin.

i dont think so hunni! unless you can get the court to order him to back pay what he never paid, which im not sure you could, i really dont think its likely! im sorry hun! xx

your friend can sue the Dad to get it. Call a lawyer in your town they'll clarify it.

its CHILD support not adult support.
