I had problems with a guy that has his dog crapping on my lawn and you woul dthink he would be the one getting the fence, but I'm tired of it and dont want to see his dog on my property. We are on a non speaking basis, do i need to advise my annoying neighbor of my intent to put up a fence?

Usually not, however most communities have regulations and permits to put up a fence. I would check with your city hall if a permit is needed. They will also be able to tell you height restrictions, etc.

Wouldn't it be easier to just inform law enforcement that the jerk is allowing his dog on your property to do it's business? Most areas have leash laws on record, and you could hammer him with a few fines. Once his wallet is affected, maybe he will keep better control of little "Fluffy".

You need to check with the city...If you live inside the city limits...All cities and states are different...
You also have to have a building permit if the fence is a certain height.

And the real kicker is ....yes you have to tell your neighbor ....in order to put the fence up the rules are..........The good side faces his house the not so pretty faces your yard and house. In order to do it that way you have to do it from his side of the yard.

The lots in my community are cut in such a way that I can see five neighbors' yards from my patio. In those yards, I see five different fence types -- all wood, but varying styles. Just this past fall, my good neighbor behind me replaced his whole fence and asked if I would assist in financing the section that set between our lots. Since my male breeding pup had been slipping through the old fence and marking his yard -- plus I wanted a newer model toward the back -- I agreed. And now I have a fantastic new fence on the back -- but it doesn't quite match the weathered fencing on the three other sides of the yard.

I prefer to call them posts. Generally they go on the inside of the area that is being enclosed. For residential use, they should be on the inside so the neighbor enjoys looking at the better of the two sides. In fact, according to some building codes, this is not optional. You must face the best looking side of a fence towards the road and your neighbor. Check your local code requirements always before buying and erecting a fence.

Even if not required by local building codes, it is more neighborly to keep the posts and rails on the inside of the fence, which is your side. Your property will look better when viewed from the road.

The permit depends on where you live. I'm putting up some fence in my yard to keep my dog in without having him tied up. I don't need a permit, but I am limited as to how close I can come to the street with the 6 foot fence. Call your local building inspector, zoning commission or whoever handles that stuff in your area.

I am also talking to the neighbors to avoid property line disputes, and save the money a surveyor would cost. If you just put it up, without talking to them you could find yourself in court over a dispute.

Think twice about a 6 ft. fence in front of your home, may look like a fortress besides concealing your home and making it susceptible to thieves. A permit is necessary in most communities, permission from neighbors is just a common courtesy. Unless of course you were blocking say a view of the ocean which they have a right to enjoy as well as you, then it would be a legal issue.

A 5 foot fence would not be questioned. A six foot fence would need a permit, showing why, etc.. I doubt if the dog could get over a 5 foot fence, don't you? For this reason, I have 5' fences all around our property.

put it a couple feet inside your property, i think that is one of the rules, my neighbor has a fence like that, which makes my yard bigger, and he mows that strip for me too. Its not a free country anymore, so im sure you will have to get permission, but that shouldnt be too much of a problem, and if you could afford to plant a hedge there it would look better and conceal your home from idiots walking by peeping too. I couldnt live with prying eyes, i hate it that people have even built near enough to see my house. Your neighbor will probably be happy that you didnt poison his mutt and that he doesnt have to look at your house either.

If you live in a community with a Home Owners Association, check with them BEFORE putting up the fence. Many have rules regarding fences. In the neighborhood I used to live in, corner lots could not have any type of fence. Many prohibit chain link; etc.
Also check with your local zoning dept. They will be able to give you the info also.

If when u put up a fence on your property, put it 6 inches inside ur property. that way the neighbor will have to reach across ur property line to get to ur fence. He cannot tie onto the fence without ur permission either. U will loose the use of a little of ur property but it is worth it. I have done that on both of the houses that i have owned. good Luck with the neighbors, i hav a rent house on both sides of me. so know the feeling

It depends on your local ordinance. Check with your city, village, or township about fence rules. You may have to get a permit. I doubt very much that you will need your neighbor's consent.

Before you put up a fence, look in to the law coming to your favour in regard to public litering. The owner of the dog can be held liable for his dogs doing in your lawn.
