if the husband of a woman is not carrying his responsibilities (socially,morally as well as financially) towards his wife & the child (although the woman is financially stable from her maternal side), is she eligible for seeking the justice as she is being tortured mentally. The intentions of her husband & in-laws are quite doubtful. They are not taking care of her nor they are in touch with her. In-laws are only interested with money matters of both the husband & wife (individually what they possess) & husband too is interested in the maternal property deals of his wife.

Now your case actually requires a matrimonial counseling rather then legal solution. It is very easy for me to suggest you to make complaint against your husband & in laws under section 498A of Indian Penal Code for causing you mental cruelty & get them punished with imprisonment for the same, but where all this lead to ? Just it will result in breaking the matrimonial home that will bad for every one & worst for your child. I can also suggest you to make a complaint against him & your in-law under the latest Protection of women against the domestic violence Act, 2005 & get a protection & maintenance order from the court, where it will lead to? An irreparable crack in you matrimonial home. So the best course left with you is to get a marriage counselor who will make both of you sit together & solve your domestic problems in an amicable manner. First try to get family counselling from a qualified marriage counsellor (of course along with the husband) for living together. If it does not work, better to get separated through the court of law for a peaceful life thereafter.

A woman can get justice legal system will help her but other possible means are to be applied first. Before taking firm action the husband should be warned politely but firmly

Your rights in this case are unlimited. There are lots and lots of protection given under various laws in this regard. You can use them.

First of all you decide what do you basically want. Then only you will be able to get the remedy out of that.

In all kinds of relations if carrying out responsibility and discharge of ones duty" (from both the sides)comes first. there shall be no problems at all. when it is active from one side and passive from other side then only patiens can solve problems (but one some times think that patience has alimit while it is untrue because only physical things have limits) some one has rightly said: patience bear sweet fruits.
