The area is not enclosed by a roof or walls. Food is served to these tables and I would like to allow smoking there too.

Hi,

Yes you can allow people to smoke outside. Over the summer months, you may want to think about having half of the area outside for smoking and the other half for non-smoking - as the non-smokers will probably want to eat outside too when it's hot and sunny!

I smoke and I'm gonna miss being able to light up in pubs and restaurants! But I do see that it's a very good thing for all of our health ;-)

I believe that this depends on the municipality in which your restaurant is located. For example, in Belmont California, the answer would be a resounding "NO!", as all smoking in public is illegal there now, you can only smoke in your own home and enclosed yard.

You would need to check with your local authorities to be certain.

Not for long it seems.
Plans to stop smoking OUTSIDE offices and restaurants — and even on football terraces — are also being drawn up and will be put before Parliament within a few months.

From Scotland - you can smoke at outside tables as long as they are more than 6 feet from the doorways.

Yes you can. However you should clearly label the area for Smokers so any non smokers using the area know that there may be smoke around.
