1) I'm in the process of filing divorce papers with free legal aid clinic in Calif., but I suspected my husband has also filed with different legal aid clinic too because a process server came to my home today trying to serve me papers. If these are divorce papers filed by my husband, is my filing papers no good now? Can I ignore the server and go ahead and file my own papers?

2) To serve divorce papers to my husband, do I have to know his new address? I don't know where he lives although I do know the county he lives in. Since I don't know his address, will the court help me locate him?

3) If I go ahead and sign the papers served by a process server, can I get my own private lawyer? I have a house which I'm afraid my husband will force me to sell it and also I am requesting alimony from him... will i need a lawyer? If I don't need one, can I fight for these at the hearing?

Any thorough answers with details would be greatly appreciated!

Since you own a house and appear to have assets, you really should contact a lawyer. Any answer you get here could put your assets in legal jeopardy.

the first papers filed usually determines petitioner/respondent but it is for a court commissioner to decide.

the court will attempt to find him, if necessary.

you should get a lawyer of your own and, yes, these are all negotiable issues in court.

you need a job not alimony, why should he pay you if your no longer with him?
