Is the act of creating enough to classify the result as art or is it the product that should be judged art or not?

I believe the answer to your first question is no. Just because you are able to 'create' something, does not make the act of creation, art. Also just because something comes into being does not make it art. Example: someone created Corn Flakes, that does not make it art.
Art is expression more than product.
But I'm not sure I understood your question.

It is used in both ways, but you can use the phrases ''work(s) of art" and ''artworks'' to distinguish the two
