How do you figure out who the custodial parent would be in a dissolved relationship?

A friend of mine has ended a 6 year relationship in which he has two children. Currently, the ex girlfriend have the kids, but she doesn't work and is kinda nutty. My friend wants to know who has the legal right to the kids. He has a job, his own home, etc. How does he go about getting his kids back? Plus, his ex girlfriend is threatening to take the kids and leave the state. Anyone with experience would be tremendously helpful.

they both have legal rights. its up to the judge.
