Father of my two daughters shows up after 9 years of no contact. My girls dont even know who he is, Ive been with my husband for almost 9 years. He is all they know. Now their biological father has called me and says he wants to be part of their lives. So I told him to get a lawyer, that was 5 months ago. Hes been harrassing me with phone calls and text messages. We had a really rough past hes been jailed for stalking me, hitting me and the final straw he abused my son who was 3 at the time. He punched him in the side of the head and bit his face and bruised his whole backside. After all these years what rights does he have. What should be the first thing I should do? A restraining order? I really dont know what to do. Im unsure if I have full custody or not. An email address would really help so I could fill you in with ALL the details.

Ok, first of all, take a deep breath. You sound panic-ridden, as I would be!!!

First things first... as much as it stinks, yes he has rights (but so do you). If there is no court order, then he would have to get one to use those rights (and thats where you can fight for your children's rights)

OK here goes... get prepared for a fight.
-Change your phone number.
-Find any and all evidence to prove his abusiveness to you and especially to your son (police reports, medical bills, witnesses, court transcripts).
-Get a copy of any court order(divorce decree, child support/visitation, etc).
-You may want to check out what he's done in the time he's been away from your children (most abusers don't just do it to one person, you may get lucky and find proof that he's done it to another woman)
-Shop for a lawyer now, but don't retain them yet. Find someone you are comfortable with, and put his/her name on speed dial in the event that you need them.

Finally, relax, and make sure that you go give your kids a hug. Oh, and give your man a huge hug and a thank you for me, as I have the utmost respect for the dads "that didn't have to be" in the words of Brad Paisley.
