She would have to be the one to prove that the sex was forced on her, either that she was drunk, drugged,, or physically forced. I imagine that if she had no bruises on her body (and was not a minor) that the police would probably not do much. After all the state has the burden of proving rape "beyond a reasonable doubt". If it's her word against the man's, and there is no physical evidence to back it up (no bruises, no trace of "date rape" drugs, etc.), then her word alone is not going to prove the case beyond a reasonable doubt.

Well, maybe you'd be in trouble, but a professional should be able to tell if sex was forced or not in an exam. Most rapists are not the gentle type- so, unless you beat her while you did it, then I wouldnt worry too much. My advice would be to not screw around with people you hardly know- obviously AIDS isn't the only thing you have to worry about.

It's a tough problem. Several generations ago it was considered morally wrong to have intercourse unless you were married to each other. Nowadays, few people follow that rule. But the rule prevented this kind of situation. So by not following moral rules that developed over thousands of years of experience, you shouldn't be surprised at troublesome results like this one.

if she reports it as a rape, they will more than likely do an exam... see if she's bruised, see if it actually looks like you did rape her (against her wishes) ... they'd look for bruising on the neck, arms, forced entry, etc...
if they don't find anything substantial, then you should have no problem, unless...
did you go out drinking? even just one or two drinks, because she could claim she was drunk, and even if she agrees while drunk, it's considered rape, since she can't make a rational decision... even if she wasn't drunk, if you were at a bar and someone saw her drinking, she can use this against you.

if you tell the court she willingly had sex with you and there was no signs of forced penetration, and there was no witnesses of you forceing her to have sex, then there is nothing she can do about it...
