I want to make sure an idiot doesn't jump the fence into my backyard, jump into my pool head first, bust his head open on the bottom of the pool, pass out and nearly drown and then try to sue me for breaking into my property and injuring himself.

It takes a village to raise an idiot and an idiot to raze a village.

You put up a big stinking fence, at least 6 feet tall. Put signs on the outside that say, "No Trespassing", and last get a really good homeowners insurance policy with umbrella coverage.

The fence is constructive notice to the world that you do not want unauthorized people wandering onto your property beyond the fence. The "No Trespassing" signs warn people to keep out, so that they are on actual notice that if they go beyond the fence, they ARE trespassing.

And if an idiot jumps your fence, jumps into your pool, busts his head open at the bottom, passes out and nearly drowns, and then sues you for his injuries, you have some mighty good defenses, like you owe no duty to a trespasser who's on notice.

But because this is America and anyone can sue anybody for anything, even if they have no chance of winning, you buy homeowners insurance and a swank umbrella policy and when the idiot sues you, the insurance company owes you a defense.

As they say, the duty to defend is broader than the duty to render coverage.

The fence and signs are designed to keep the idiots out, but if that doesn't work, you have insurance to protect you against baseless lawsuits.

Just in case you're being serious: Post a sign that reads "Swim at your own risk, the owner of this property is not responsible for accidental or purposeful drowning, (attempted or successful). By swimming in this pool the swimmer take FULL responsiblilty for any and all accidents, injuries, or deaths that may occur" That will not only protect you from insane tresspassing chlorine junkies but, also from any "Tommy Lee situations".
