I got a citation last year for speeding, which is appearing on my record. According to Minnesota statute 171.12 subvid. 6, the citation isn't reportable, meaning it shouldn't be on my record. How would I go about clearing that up?

I was going 64 in a 55 in Minnesota (my state of residency) and I have a class D Minnesota license. Here is what the statute reads:

Subd. 6. Certain convictions not recorded. (a) Except as provided in paragraph (b), the
department shall not keep on the record of a driver any conviction for a violation of a speed limit
of 55 or 60 miles per hour unless the violation consisted of a speed greater than ten miles per
hour in excess of a 55 miles per hour speed limit, or more than five miles per hour in excess
of a 60 miles per hour speed limit.
(b) This subdivision does not apply to (1) a violation that occurs in a commercial motor
vehicle, or (2) a violation committed by a holder of a class A, B, or C commercial driver's
license, without regard to whether the violation was committed in a commercial motor vehicle or
another vehicle.

Contact the DMV, and make sure you have that law in front of you to recite. Request that the violation be removed. You may have to do some paperwork, but if it is a non-reportable violation to begin with, it shouldn't be too hard to have it removed.

You need a hearing with your local motor vehicle department. In Delaware, speeding is a reportable offense and will go on your record. I think this is true for most states. What does Minnesota statute 171.12 subvid 6 actually say. You may be minsterpreting.

Contact the State Bureau Of Motor Vehicles and ask for someone who can talk to you about your driving record.

if you have the current reading of the statute, and it covers speeding citations, then you need to talk to:
1. The court that handled the proceedings
and
2. The people at your DMV office of driving records.
(this is not the DMV where you go for your tests or renewals)

If you get a ticket for speeding it goes on your record. If you successfully fought the ticket and a judge dismissed it then you have to speak to the judge who dismissed the charges.

You need to contact the local DMV. I would also go to the court and obtain the proper paper work that shows it isn't reportable.
