My Roommate owes me $ 1800.00 Dollars for rent for the past 3 1/2 months I had to evict him this month because I’m not letting him stay and not pay. Im trying to work out a payment plan to get the money from him. He is just blowing it off. I went so far as to tell him that I would take $ 200.00 a month for the next 9 Month because I know that he does not have it right now. But I think that I just might have to go to court to get the money. How does small claims court work? And is it worth it or should I just keep pestering him and try to get the money myself.

once you have a judgment against him you can garnish his wages or take money directly from this bank account, or even take his property that is monitarily equal to the amount he owes you. small claims is the most user friendly court system. you can't have an attorney & there is not jury nor appeal. once you file a claim, he's got a certain amount of time to respond or the judge will give you everything you ask for. if he DOES respond, there will be a hearing, so make sure to bring your lease & any copies of checks, etc. to prove your case. then once you have a judgment, you can decide in which way you want to get your money from him.

File on him in small claims court. When you file you will be asked to outline your claim. Then an order to appear will be served on your ex roommate. When you appear before the judge they will ask you to explain why you are suing and ask them for their story and then ask any important questions they will need to know to rule on the case. Watch the People's Court. Its a lot like that but less theatrical. If the judge rules in your favor you still will need to collect. Fortunately a small claims judgment will allow you to garnish the person's wages if they don't pay.

Make sure you are prepared and hopefully you have lots of proof in writing.

Take him to court. You might want to try the televised courts becuase they'll pay you in the end even if he doesn't have the money.

it's inexpensive to file a case in small claims and it's a very informal setting. You'll do fine.

Good luck. I hope his name was on the lease. Start gathering proof that he lived there. Mail is always a good thing.
