I signed a lease and paid a pet deposit. Now I am told that I can not stay at the apartment because of the breed of my dog. The complex is going to let me out of the lease. I was told that I have 7 days to "decide what I am going to do". Legally, how long do I have to vacate the property?

They would have to give you a 3 day notice to quit if they were telling you to leave. Until you receive that you're not being asked to leave.

Unless you were questioned about the breed of your pet and lied, or the landlord provided something that indicated certain breeds were not permitted, you don't have to go anywhere in my opinion. As long as you did not enter the lease under false pretenses, the landlord cannot arbitrarily terminate the lease after the fact.

That said, with the knowledge that you (your dog) are unwanted, you might have a bargaining position to request compensation for your inconvenience and/or expenses. Check your state's landlord & tenant law, read your lease and any other papers you signed carefully, and determine whether any mention is made of prohibited breeds. You should also look closely at your lease and/or pet agreement to see if it contains language allowing the landlord to revoke consent for a pet with (or without) cause.

Did they have it in writing the types of breeds they won't allow and did you look at/read this prior to moving in? I know the one I'm currently in (and turning my 30 day notice tonight...my renting days are 30 days from being done) specifically states we are not allowed Rottweilers or Pit Bulls, but any other breed (large or not) is welcome. Now, as far as the 7 days to decide what you are going to do, I'm not sure, but possibly to decide whether or not you will stay minus the dog or decide to leave. If you have specific questions, your best bet would be to contact the leasing office for your apartment complex.

depends on where you are at. and the type of notice you received, it only says 7 days to decide? id say on the 6th day decide to take them a letter saying you will vacate in 30 days. make sure you have all rent paid up through what ever epriod you stay.
