for damages that was not my fault, the water heater on the second floor flooded my apt. & they didnt help much, only dryed the carpet out, so i moved out 2 months later, they want me to pay alot of money for damages. Any work that was done was crapy like the dishwasher, it was put in poorly it falls out when anyone opens it. the door was not properly installed when I moved in. There is mold in the walls, they wouldnt do anything about it. What should I do or say? I dont want money I just dont want to pay for there poor maintenance.

The water damage is the responsibility of the owner of the 2nd floor unit (assumingly the same owner as your unit). Write them a letter that the mold in your walls made you sick and are in the process of getting an attorney to sue them. I bet they'll back off in no time.

A failed water heater is not your fault. However, if they sue you you MUST defend yourself in court or they WILL win a default judgment.

Hopefully this is Small Claims Court. You don't need an attorney, and in most states you're not even allowed to have one. Bring any documentation you have with you including copies of the letters you sent to the landlord requesting repairs, photos of the damage from the water heater, pictures of the moldy walls at move-in, etc. You should do fine.

Hello...... the water heater is not something that you could have messed up.

Write down all that happened. Call them and request that you wish to see the unit as it is now. They will say no but again write it down. Call the company and say that if this is not resolved you you shall take it to court. Odds are they will choose to absolve you of this debt as they just want to prey on people who are not persistant. Call the local county as well. They bank on people not being smart.

They may pay you!

It doesn't sound like it was your fault but there is always two opposing claims in a lawsuit so for your own protection I recommend you get a local legal beagle to help you it can get really nasty if your rights are not protected by a professional
