for damages that was not my fault, the water heater on the second floor flooded my apt. & they didnt help much, only dryed the carpet out, so i moved out 2 months later, they want me to pay alot of money for damages. Any work that was done was crapy like the dishwasher, it was put in poorly it falls out when anyone opens it. the door was not properly installed when I moved in. There is mold in the walls, they wouldnt do anything about it. What should I do or say? I dont want money I just dont want to pay for there poor maintenance.

Gather all your documentation about the leak from upstairs and the dishwasher. You did write notes and received notes back from the manager didn't you? That should be all you need if it comes to going to court. Sometimes landlords bluff and some do pay them. If the facts are as you stated you shouldn't have a problem

I'm assuming that the water heater on the second floor wasn't yours. If this is the case, then you shouldn't be liable for the damages to your apartment. Depending on what state you live in and your lease agreement, the person who had the faulty water heater is liable, at least that's how it works in my apt complex.

Nonetheless, try and get as much documentation to show that you are not at fault. If you moved out two months later, with out giving proper notice, or broke your lease, then your landlord would be entitled to take you to court, but I don't htink they can sue you for the water damage.

If they are trying to sue you, then you need to seek the advice of a lawyer. Many lawyers give free consultations. You may want to just let them know that you have a lawyer and will be launching a counter suit, that may make them back off.

when you moved in, did you fill out a damage report on things? if not, then they can claim you caused all the damage to the apartment. you need to have your damage report & then if you documented calling maintenence on the other issues, who you spoke to etc. in court you'll need documentation cuz it's basically a he said/she said type of situation unless you have receipts or something to prove your case.

I hope you took pictures. If it went the way you say it did, you shouldn't have much problem. You can't be held responsible for the failure of their fixtures.

Do you have proof that the damages are not your fault? If not, sorry but you are screwed.
