if you want him to pay child support and he is not on the birth certificate YOU will have to pay for a DNA test to prove he is the father, its easier to just put him on there to begin with,
congrats on baby!!

No, that's not correct. Name has nothing to do with it. There are two ways to get him on the birth certificate if you aren't married. The first is for him to voluntarily sign an affidavit of paternity, the second is through a court ordered DNA test. Even with him on the bc you can give the baby any first middle and last name that you want. But, you won't be able to get court ordered child support without him being legally identified as the father.

It doesn't matter if you put him on the certificate or not, if you guys are not married then you have to establish paternity before he has to pay child support and/or has any rights to the baby. I've been through it and my husband is going through it with his ex-girlfriend. His daughter with her is almost 6 and she has not let him see her since she was 2 because we got married and we talked to an attorney. The attorney said that even though he is on the birth certificate since they were not married a paternity test has to be done. She thought she would get back support and was going to go along with it and now she will be drug into court because she found out that since paternity has not been established she would not get back support and that child support would not be ordered to started until after the paternity test is complete. If you want support you need to have a paternity test done as soon as the baby is born so that if he does not pay support you can get the back support.

His name doesn't have to be on the birth certificate for you to get child support. They will do a paternity test, but most times the court will pay for it. Congrats on your baby boy!!!!!

You don't have to give the baby his name!!! You don't even have to put him on the birth certificate!! All you have to do is go to social services after the baby is born and request a paternity test. (they pretty much make you do it anyway if you are on any kind of help) Even after the paternity test, you will not have to change his name or anything!!! I Strongly recommend giving the baby your name if he will be living with you. It makes things much easier! Good Luck!!!!!!!

What a shame. The baby isn't even born yet and already you're thinking like a true "Golddigger". The question you should be asking yourself is "How do you plan to support your child?" Or was your plan to leech off the child's Father for the next 18 years? I feel sorry for that baby. Especially since his mother can't even spell, or articulate a well thought out sentence.

You don't have to give him the fathers last name. You do need to have him on the birth certificate so that you won't have to pay for the DNA test.

Yes, however you better be right, because if dna proves he isnt the father it come back to bite you

2007-03-27 13:29:16 · answer #9 · answered by skcs11 7 · 0 0

you should put his name on the birth cert if he's the father.

but if not married, the court will more then likely order a DNA test also...

today, child support is based upon BOTH parents incomes, thus BOTH parents contribute to the childs needs.
