I mean, they knew when they started taking the drug that its truly long-term effects hadn't been documented. For that matter, if for some reason you're able to justify suing anyone, why not the FDA? The pharmaceutical company sent a chemical off with the intention of finding out if the watchdogs for this sort of thing thought it was safe enough to prescribe. Who can blame them for selling it when it comes back with the greenlight? There aren't honestly people out there thinking we tested... Oh, I don't know... Prozac since 1920 are there? That's what it would take to prove that prolonged contact doesn't accelerate brainworm embryo growth in senior citizens, or some other such less silly thing.

Because the drug companies are supposed to test thier drugs for long periods of time. By long term effects you are talking about 2-6 years of taking the drug. Drug trials last more than 2 years. The FDA gets reports from the company of their findings. The companies get sued because its their fault.

Many of those law suits cause of action claim that the companies were negligent with their standard of care or duty of care. The FDA certifies the chemicals using the research that the company provides. If the company says its safe, the FDA tends to agree.

you make an exellent point , if a drug is approved by the fda they should be held liable , not the company that used the fda as a service to ensure the drugs safety
