My husband was in an accident two weeks ago. His cruise control kicked in by itself, then would not disengage. My husband tried hitting the off button, and jamming the brakes, to no avail, the car continued to accelerate. We had a 2004 Chevy Malibu, which is now totaled because my husband went into a gully in order to avoid a head on collision with a semi truck. Anyone else have this kind of problem with a Chevy? Husband got a ticket for Failure to Control, in which we are trying to fight. We have already checked for recalls, there were none for anything electrical. And thankfully my husband managed to walk away from the accident.

Yes we have insurance and I discussed the problem with them, they not only will not check the cruise control, they are also not responsible for fixing it since technically it was not broken in the crash. I'm glad it was totaled cause I certainly wouldnt have driven it again.

The Malibu has a drive by wire throttle system, so there is no physical cruise cable like older systems. The computer controls all accelerator functions. The brake and the switch inputs go directly to the computer. You had to have had a computer problem, because the shut down inputs are supposed to be fail safe. As far as proving it....that's a different story. It is much easier to blame the driver than the vehicle for GM. Until this starts happening on a larger scale, you most likely won't get anywhere.

Hopefully, you had insurance, if so, then your insurance company will investigate the cause of the accident. If what you say is true and they find the same reason, then you will have a great law suit against GM, good luck.
