If he has to climb over a fence there are strips of spikes that you can buy to hammer on top of the fence so it is not easy for him to touch the top of it. They are perfectly legal. B&Q or any online DIY type site will sell them.
Failing that if you catch him in the act a few times and can soak him with a large water pistol that will soon deter him.

Well, it does rather depend on the cat, which is why there are so many ideas and old wives tales, some cats can be persistent though, like the one which visits your garden, and / or stupid, and don't get the message, btw I have cats, and what some habits are described as endearing and curious, are usually plain stupidity on the cat's part, e.g. Is that your cat which just sits and stares at me when i try to shoo it away, or make enough noise to deter a charging bull, he is so fearless, and proud, a real character!? Answer , yes it is, but it is not fearless and proud, it's just stupidity on his part, and doesn't get the message. So in your case the cat may actually look forward to what you have come up with next, and probably be one of the few who actually like pepper, or slightly deaf, in the case of a sonic repellant. so it is perhaps a matter of soldiering on. Cats being habitual creatures will have a route or two in their feline heads to take at night, and the toilet break is on your patch, as you already know. In fact cats will defecate in their own gardens, territory, mine do sometimes, as there is a particularly nice bit of loose earth where a pampas grass was removed, and they love to scrape around, and try to cover the evidence. and when it is raining it's a quick dash and splash, so to speak.
Anyway, cats do like their privacy when going about their business, they are of course exposed, and somewhat vulnerable from other living creatures, what they do not like is to be suddenly illuminated in a bath of bright light, for a cat it is immediate loss of street credibility, you will notice their ears will go flat, and back, and the expression is one of sheer indignity and despair. At that moment it might not race away remember, perhaps because of the weight of the shame, but, it will think twice before returning, if it is stupid as well as mine, which there is a good chance it is, it may well return as the memory fades, however a repeat of the spotlight will surely prompt the cat into a recollection of sufficient magnitude to penetrate even the thickest of the species.
So, set up a movement sensor triggered bright light, or two, I wonder if a sound track of laughter and mirth would be beneficial?
have fun

I am horrified that someone would suggest shooting a cat... tell you what if they shot one of mine I would take appropriate revenge and they would'nt be able to sit for a month!! and I would give them the vets bill...I do feel for you. As a gardener and cat owner/lover I have a battle too but I have used various things.. tin foil strips .. they hate that.. just small twigs spread over the border also works.. also I find once a border is established they lose interest..A product called scaredy cat works for some people.. or simply make an area for the cat.. plant catnep (a pretty plant with blue flowers that they munch on and go all dopey and playful on) in your border they won't poo where their drugs are!! I also have an area that I encourage them to use for poo's and they seem obliging enough..

COLEUS CANINA. I've not tried it but apparently this plant deters cats (and dogs). I've seen it for sale as the "Scardey-cat plant". I've tried most of the other things you have with little success, and plan to try this one soon but with little hope.

low-powered b-b gun ;). j/k!!
BTW Nomio, I would never seriously suggest that someone shoot a cat. No one has a sense of humor any more. I'm sorry I horrified you, but really, why would you take something like that seriously.
Additionally, a b-b gun wouldn't even break the skin at a distance. I would know. I've been shot a coulple of times!

You say you've tried pepper dust. I'm not sure what that is, but I've used plain black pepper. Applied liberally and re-applied as needed. It worked for me.
