I'm going thru a divorce and my future ex called my work and told them I'd be quitting in 2 months. Now they want me to sign a contract saying I'll stay until Dec. 28th. Is that legal? Do I have to sign? And can they fire me if I don't? Its more of a issue of his word against mine.

Ask a lawyer, they would know what you should do regarding the fact that your ex called, and also what you can and cannot do, are you really planning on quitting? All of these aspects need to be addressed.

I think it is illegal on the part of an employer to bind their employees through contracts in the US. The basic idea is that the employee is not a bonded labourer. Even if you sign the contract, the document is not legally binding. A friend of mine faced a similar situation when he was on work visa in the country but you should confirm these facts from a lawyer.

If your employer has stated that you are an "at will" employee, asking you to sign an employment contract violates their own policy.

The exception may be if they are offering you something of value in exchange for signing. Employment contracts such as this are often used at the executive level, or to retain an employee through an upcoming business transition such as a layoff. In these cases, the employee is offered a value (x weeks of salary, or a bonus, for example) in order to stay through the end date of the contract.

You'd have to check with an employment lawyer in your area to determine if employment contracts such as this are valid in your state - not all states permit them. Many lawyers offer a free consultation, so ask first.
