but is under contract until the end of april. they have now notified the council that they do not live there anymore and i have just received a council tax bill. As the owner do i have the right to re let it now or should i wait until the end of the official notice. i do not intend to sue for loss of rent.

It annoys the heck out of me when people do this.

A) Confirm personally that they have moved out of the property
- Have they damaged the property? If yes then you may want to reconsider not asking for that rent money back. Think of how much money you'll have to spend to get the property habitable again
- Have they left any goods in the property?
By confirming PERSONALLY that they have left as they have informed you move onto the next step
2) Advertise the property - Re let it ASAP, get it back into the market so that any rent lost or damages that need to be paid for will be covered by your insurance as well as a new lease.
3) I seriously advise to re consider not charging them for lost rent - have they given sufficient notice? when does their lease run out (obviously if it runs out on the 2nd of April then would 1 week hurt you?)
Imagine if they have left the property in a shocking state - whose going to pay for repairs - you have every right to ask for the money o repair damages by tenants.

Don't wait...action straight away. In the long run it's costing you money that you'd need to pay on a mortgage or loan.

You would be within your rights to demand rent until the end of April. Of course you can re let it - don't let it sit empty and lose out even more because of your tenant. Hope he/she doesn't have the cheek to ask you for references after this.

Go ahead with the re-letting. If the property is empty and they have stopped paying rent, and having notified the council tax dept accordingly, they officially do not reside there.

Re let it. Don't give them deposit back either. Poeple are crying out for housing. But they also need to stick to the contract.

well..they have confirmed they don't live there any more...so they have broken the contract already...why don't you check whether this flat is actually empty and re-rent it...
