if your child is taken from you for substance abuse allegations and you pass the required drug test will cps return your child even when they have set up a court date to attempt to terminate your rights as a parent?

CPS is out of control, if they are moving towards termination they will not stop until it is done. A personal example and I really hope anyone from CPS is reading....

My ex - divorced for 3 years - I have sole custody of our child. She remarried and had a baby. 5 days after the birth the child shows up in Marble Falls with a broken femur, (thigh bone), and the state stepped in. I am living 200 miles away. Mom has not seen our child in 2 years and pays no child support. The state removed custody from me and wanted to put my baby in foster care to protect her from the mom. Investigation and trial lasted 13 months. She got a court appointed attorney, the injured baby and my daughter did too. I had to shell out 4,000.00 for my attorney. The judge asks why I was even involved and the case worker got severely admonished in open court. I cannot complain nor sue the state. I was actually told by a CPS supervisor that CPS can do anything they deem essential in the protection of a child. Even if they went overboard in my case. The ex lost that child and had her visitation changed to supervised visits but has yet to see our child.

I have since written every CPS case worker I pulled over for the max tickets I could. Wrong, I admit but I felt better.

There is obviously much, much more to this story as cps would not terminate any parental rights on just a drug test.

Good luck on that one, my family member went through the same thing, had a hair folicle test done, negative for drugs, the judge didn't even look at the test results, he ruled with CPS regardless of what proof was provided. Kangaroo courts for sure....yes, they will do everything in their power to take your kid. They are state run kidnappers...

It would depend on how many the parent had failed before. One negative drug test does not erase 6 months of positive ones.

they can do what ever they want they base there decisions on a preponderance of evidence not fact or law the judgment is I all about the safety of your children not the law or facts that's why a lot of lawyers don't want a cps case its a crap shoot the federal government gives them bonuses for adopting children and they have to take so many children because that's there job and the government makes millions of dollars in child support and services cause they get the money not the children or the foster family
