I know there are certian things that can and cannot be asked and said. what are some of things or laws here in the U.S.?

The rules for references are much the same as the rules for an interview. Questions about an applicant's age, race, gender, religion, sexual orientation, national origin, etc. may not be asked of the applicant or the references. A basic reference check would include something along the lines of:

-Sara has given me your name as a reference. Can you tell me in what capacity you know her? (co-worker, employee, boss, etc.)
-She is a candidate for (position.) Would you recommend her for a role like that?
-What responsibilities did Sara oversee while in your employ?
-What were some of Sara's strengths?
-Was there anything you wanted Sara to improve on in her work?
-Would you rehire her?
-Is there anyone else you think I should speak to with respect to Sara's performance at your company?

All work-related, nothing illegal. :)
