You have a lot of answers to this question, but I just could not resist to add to the pot.

There is quite a difference between "intelligence" and "smarts".

Man may be the most "intelligent" because of the brain's capacity. But, I truely believe that man is not the "smartest" of all the animals ... as a matter of fact, man is probably the dumbest of all the animals. What other animal do you know gets up when its sleepy, goes to sleep when its not; works for its food and housing and then gives most of it away in the form of taxes and supporting the other animals that won't work for their living? Man is really the dumbest animal alive! My dog has me well trained: I feed him when he's hungry and scratch him when he has an itch. I do this because he looks cute! How dumb is the dog?

The Chimp is our closest animal relative. Did you know that genetically Chimps are closer to us than they are to the Gorilla? However, the Elephant is a completely different species and are considered highly intelligent. They are one of very few animals (the Chimp is another one) that recognized themselves in a reflection in a mirror? As much as we love and respect our fellow dogs they only see another dog in a mirror not themselves. Then there is the Dolphin and some of the Parrots in South America, so it is very hard to pin down to one. Sorry!!

after seeing your english grammar I would have to remove humans from the the top of the list completely. the next stage is subjective, many animals show what may be considered rudamentary higher resoning functions such as problem solving. also many animals are able to maintain organized social structures for prolonged time periods.( good heavens now we really need to take humans off the list). chimps in general are very human like in their psycological profile, having social structure and family organization. whales also have these skills for water based animals. but then again Rodents are tremendous problem solvers with great social skills, so I guess we can add them to the list. horses can be taught to count, pigs can be taught to ride skateboards (yes I have seen it with my own eyes) and dogs can be taught to mimic a number of human words. at this piont you will have to decide what constitutes most intelligent, octopi can escape from traps, open bottles, and walk across the deck of a ship to get back to water. just thought I would throw them in there for good measure.

Most would say chimps, but dolphins, whales, orangs and elephants are all self aware, know who they are, and bond closely to each other. The chimp, being present man's closest relative, is probably the one most likely to be named.
