If not, why should we not ban it?

Why ban it? If people really care that much about being around smoke they will not go to places that allow smoking, business owners will see all of their business slipping away and you will se a bunch of non-smoking places open up.

Do we really need a law for something that people can easily change by voting with their feet and wallets?

I think this has more to do with people deciding that they know what is better for everyone else and will do whatever they please to make other people conform to what they think is right.

I mean really, why do you think there are not a ton of bars opening up that ban smoking on their own to draw in large crowds, if so many people hate second hand smoke they would flock to those places.

As for the employees there are plenty of service jobs, check the classifieds, so if they don't want to work in a smoking establishment they don't have to.

We just don't need laws for every little thing that annoys us. I hate when parents bring small children to restaraunts and the children cry and scream the entire time. I want to ban noise pollution in restaruants. Don't these parents care about any one else, or is their need for a meal out greater than my need for peace and quiet while I eat? And don't say kids crying is not bad for me, the stress can have negative health effects.

I lived in LA for a while where smoking was banned in all buildings and it was AMAZING! I'm in Missouri now and whenever I go anywhere I come home with my car seats and clothes smelling like smoke.

We should ban it everywhere. People can go outside if they need to smoke.

People here are answering with "It shouldn't be banned because people can choose not to go to smoking establishments."
Well, that's not true. I and most people I know don't go to restaurants or ESPECIALLY bars by ourselves. You go with other people. And if other people want to go to a certain bar and there happens to be smoking, it's either you go or you sit at home.

The best thing it will do, though, is reduce smoking in general, and people will actually start to realize how ridiculous and awful the habit is.

I've lived in both places...those that restrict it in restaurants and bars, and those that don't. I prefer the places that don't allow smoking in restaurants and bars. It is a health risk for customers and employees alike, and no ventilation system is going to keep the smoke in the smoking section. You don't come out smelling like the bottom of an ashtray if you just want a quick burger.

But if you are going to ban it, be sure to have the infrastructure and the money to enforce it. They just passed a restriction on smoking in places that serve food in Las Vegas/Nevada, and it isn't being enforced. It wasn't clear on who would be fined, the customer or the bar/restaurant for allowing people to smoke, and it's been said that it will take 3-5 years to get the money and the people to go out and actually start handing out the fines.

News Flash. It is already banned in the state of Florida. The only time that a restaurant can have smoking is if they have outside seating. Can't smoke in the bars if they serve ONE ITEM of food. Only bars that serve absolutely NO food (not even a bag of potato chips) can have smoking in the establishment. Even tho I smoke I can't stand a room full of second hand smoke. So I got to a restaurant and sit outside.........works for me!

People who work in restaurants and bars have a higher risk of cancer related to second hand smoke. For this reason alone it should be banned. Also the percent of americans who dont smoke (80 percent) should not have to pay for the bad choices of the 20 percent who do. If you wish to smell shorten your life span and age faster then by all means go right on ahead, just please spare me this ordeal

I don't think it should be banned but should certainly be restricted. Some people are allergic to smoke, and it can cause serious problems in those with asthma. Also, secondhand smoke can be just as dangerous as smoking itself and is almost as likely to result in cancer. I personally want it banned, but that would be restricting the freedom of others and would severely hurt small businesses that don't have room for a smoking and a nonsmoking section.

I am a cancer survivor and I don't really want to be breathing second hand smoke.
Since non-smokers are in the majority, most places divide smoking and non-smoking. Some times they do a good job and sometimes the smoke is really bad.
If they allow smoking, I just to go there. End of problem

Banning smoking iin bars and restaurants . . . especially bars, a completely ridiculous regulation . . . gives legislators something to do in their spare time.
Meanwhile, not banning smoking in bars and restaurants gives restaurant and bar owners the right to choose whether to ban smoking, allow smoking, or divide their place into separate sections, and gives the public the right to patronize or not patronize whatever establishments they want to!
Or as they say on the Staples commercials, "That was simple!"
Any other questions?

We should because not all people who dine at restuarants are smokers. Second Hand Smoke is a worse health problem, than smoking, which is a hazard, also.

People who smoke has no respect for the people around them who do not smoke. I have a roommate who smokes and I constantly ask her to smoke outside. Nevertheless, she refuses. Some people are allergic to the smell and others do not want to get lung cancer from being around people who are too inconsiderate to smoke in designated smoking areas. Smoking should be BANNED COMPLETLY!!
