i have a friend whose sleezy soon to be ex is in the army. He is getting an extra 1,000 a month just by being married to her. They have been trying to get a divorce for about a year now but he is still getting that money which is supposed to be supporting her. Which she is not after he stayed in their apartment and kept her car. Basically getting nothing? What can happen to him if she reports this to the army. Saying he is still with her in order to get spousal support.

He might have to pay the money back to the army, or to her, depends on how the court rules.
She will have to be able to prove that they haven't been living together for a year, though.

Sorry to say since he is in the military and has
proven that he is married then you are considered
as a dependent and that is why he is getting paid
extra, does not matter if you live togeather or not.
The extra money is not for your support as it is to
offset extra costs for having a dependent. Only
way anything that can actually be done is after you
are divorced and he does not report it and still
collects the extra money then you can go to the
Judge Advocate General (JAG) and report him
in which case he would have to return all extra pay
given him after your divorce and he would probab-
ly get court-marshaled for mis use of government
funds. How do I know beause I was in the Army
for 22yrs, am retired , was responsible for 125
men at one time and believe me I have seen a
lot on family issues.One more thing JAG is loca-
ted on any military base and you as a dependent
have the right to use any legal help on base free.

Well he could get court marshaled. But unless there are actual papers that say they are separated then he is in titled to the money. Even if he isn't sending it to her. Get the papers.

Tell her to call her local army ombudsman. She should be able to best advise her of her husband's command and their policies on things.

boy oh boy is he in deep **** she better tell or she will get into trouble too. she better tell . and she better do it soon
