If you're over 18 and in college, the answer may differ than if you're in junior high or high school...If it's against the school policy for you to have your cell phone on--they can confiscate and establish a time to RETURN your PROPERTY...but with regard to READING your TEXT messages...a teacher isn't an OFFICER of the COURT, generally. They would only read your texts messages to be nosey....in front of your parents as a diciplinary action---they'd have to AGREE...If your parents/guardian agree with your position, they can first address the teacher, the principal, the school board.,etc...Just because you go to school, does not mean you forego your CONSTITUTIONAL rights---Kids sue schools all the time---you may get the laws changed--NO, they don't have the "RIGHT" to read your text messages---that's an INVASION of PRIVACY--protection is under the 4 Ammendment: Search Warrant required!....ACLU call...At the VERY LEAST indicate your case & complaint in a letter to the editor of your local paper....Don't go Silently into that dark goodnight...

I'm not sure about your school district, most say, you cannot have a cell phone thus you gave up your right by having it. As far as looking through texts, that might be over the line, however, there are many things that could impact this such as endangering yourself or other students or possible academic dishonesty or sexual abuse or abuse in general. Teachers have an obligation to act by law. Your school rules should indicate this clearly. Most do.

If its against your schools policy to have cell phones, then yes, your teacher would have a right to take it.
However, I really doubt he or she would be justified in looking at your text messages. You could probably complain if you think its important enough, but in all honesty it probably wouldnt get you very far and wouldnt really be worth it.

If you were texting in class, I'd say yes. You don't have any legal expectation of privacy in your teacher's classroom. It's just like when teachers used to confiscate notes and read them out loud (this was back in the dark age when we had to use paper to communicate). If you don't want your teacher to read them, don't bring it into his/her classroom.

when you signed that form at the beginning of the year it pretty much makes anything you bring in to the school building searchable by law so don't bring it if you don't want it searched. Otherwise just take the risk and try not to get caught again.

If you were texting or reading texts in class, yes, definitely. Especially if it was during an exam.
4th Amendment does not apply with minors in school It only applies in police cases.

don't take it to school, or...
leave it in your locker or bookbag turned off.
The schools around here will take a cell phone and not return it if they catch a kid using it. And yes, they CAN do it.
